§ 1 Preliminary Provisions 1. The NOWKOM Translations Office is at 55/73, Marszałkowska Street, apt. 22, 00-676 Warsaw (NIP Tax Identification Number: 951-145-32-79, REGON Statistical Registration Number: 013059894)
2. The NOWKOM Translations Office offers standard and sworn translation as well as conference (consecutive) and cabin (simultaneous) interpretation. We perform our services reliably and diligently, maintaining full professionalism.
3. Apart from the above mentioned services, the NOWKOM Translations Office also performs other services, such as certification, verification and proofreading.
4. All materials received from our Clients are treated as confidential. The orders are performed on time, according to the date fixed between the Client and our Office.
§ 2 Principles for Commencing Cooperation
1. Before the Order may be executed, the Client is obliged to fill out, sign and send us by mail or fax the Order Form which contains all Order conditions. The above mentioned Order Form may be delivered and signed by the Client in our Office. If the Client places an order for the first time and an invoice will be issued to a company, it is also necessary to deliver copies of valied company registration documents, i.e. a copy of an entry to the National Register of Entrepreneurs or from the Business Activity Register. The above mentioned documents may be sent by fax or delivered personally.
2. It is assumed that execution of the Order starts when all the above mentioned documents, i.e. the signed Order Form attached to these Rules and a copy of registration documents if an order is submitted by a company, are delivered to our Office.
3. The NOWKOM Translations Office takes in orders from Monday until Friday from 9 a.m. until 5 p.m. If the necessary documents are delivered after working hours of the Office, execution of the Order starts on the day following the day on which the documents were delivered, as of 9 a.m. When the documents are delivered on a non-working day, execution of the Order starts on the first working day following the day on which the documents were delivered.
4. In special cases the NOWKOM Translations Office may have the Order executed on different conditions than those mentioned above. This refers to situations in which the Client and NOWKOM establish individual conditions for cooperation.
§ 3 Conditions for Cooperation and Method of Payment
1. Following completion of the Order, NOWKOM issues an invoice which should be paid within 14 days since its issuance. The payment is made by transfer to the bank account specified in the invoice, or specified personally in our Office if the Client pays by cash.
2. In some cases, in particular for major orders, the NOWKOM Translations Office reserves the right to an advance payment before starting the translation. Furthermore, the Office reserves the right to reject an Order, especially when materials for translation are illegible, the translator is unavailable or due to other reasons.
3. Once the Order has been fulfilled, NOWKOM calculates the number of pages in the translated document for which the Client is obliged to pay. This is done by clicking “Tools” in the menu bar and then “Statistics of Words” in Microsoft Word. One page in a standard translation comprises 1,800 characters with spaces, in sworn translation and certification one page comprises 1125 characters with spaces.
4. Apart from the above mentioned rules, calculation of the total cost of an Order depends on the time limit within which it is to be executed. The time limit is chosen by the Client or determined by the Office, depending in particular on the size of the text, its complexity and specific nature materials delivered for translation. Each such time option contains a net price for a page.
5. The total net amount payable for an Order is calculated by multiplying the number of translated pages by the rate per page within a given time limit. Value Added Tax (VAT) is added to this rate. The Client is obliged to pay the gross amount.
6. Before the Order is fulfilled, a quotation can be made for the document to be translated. However, the amount in a quotation is only an approximate value, because the final exact number of pages is calculated once the translation has been completed, and in the language of the translation. The Client has no rights to any claims as regards the quotation if the number of pages after the translation differs from the number of pages contained in the said quotation.
7. For Orders sent by electronic mail, the Client is obliged to confirm the receipt of the translated document by electronic mail, fax or by phone within 48 hours. Should no such confirmation be provided, the Order is considered to have been delivered and the Client shall have no right to complain about delay in delivering the translation. NOWKOM shall not be held responsible for any delays in delivering a translation, which occurred due to reasons being beyond its control.
§ 4 Complaints
1. The Client shall be entitled to a complaint about a translation if it contains evident errors that can be specified and proven, and also if a delay in execution of the order has taken place due to reasons attributable to NOWKOM.
2. If a translation contains mistakes proven by the Client, NOWKOM undertakes to have those mistakes corrected provided that are reported by the Client within 1 month from Order completion. The time within which the mistakes may be corrected depends on the capacity and complexity of the document, and also on the number of mistakes specified and justified by the Client. Such time limit is fixed on a case-by-case basis.
3. The Client may be offered a discount due to the occurrence of the above mentioned mistakes, or due to a delay in delivering the translation due to reasons attributable to NOWKOM. The discount is determined on a case-by-case basis.
§ 5 Final Provisions
1. These Regulations shall be deemed to be binding upon the Client starting from the date of placing the Order and signing it together with these Regulations.
2. In special cases NOWKOM may act according to other rules for cooperation than those contained herein.
3. In issues not regulated by provisions of these Regulations, and arising out of this subject, binding legal regulations shall be applicable.
4. Possible disputes which may arise between the parties shall be adjudicated by the relevant court of law in Warsaw.
